NetSketch Terms of Use

1. Introduction and Acceptance

Welcome to NetSketch! These Terms of Use (“Terms”) govern your use of the NetSketch application (“Service” or “App”). By accessing or using NetSketch, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you may not use the Service.

2. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms. We will notify users of significant changes by email or through a notice on the App. Your continued use of the Service after the changes constitutes your acceptance of the revised Terms.

3. Definitions

4. User Eligibility

NetSketch is intended for individuals who are at least 18 years old. By using this Service, you represent and warrant that you are 18 years or older and are fully capable of entering into and abiding by these Terms.

5. Account Creation and Responsibilities

To use NetSketch, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. License and Access

We grant you a limited, non-exclusive, non-transferable license to use NetSketch for personal use in tracking your assets and modeling the compound growth of your assets. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Modify, adapt, hack, or reverse engineer the Service.
• Use the Service in a way that could impair the functionality or security of the Service.

7. User Content

By using NetSketch, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display the content you provide for the purpose of operating and improving the Service. You are solely responsible for the accuracy, quality, and legality of the content you submit.

8. Intellectual Property

NetSketch and its entire contents, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works based on any part of the Service without our express written permission.

9. Payment and Subscriptions

NetSketch requires a one-time payment for lifetime access to the Service. This payment grants you access to the Service for the lifetime of the product. No additional subscriptions or recurring payments are required. All payments are non-refundable.

10. Termination and Suspension

We may terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Disclaimers and Limitation of Liability

NetSketch is provided on an “as is” and “as available” basis. We do not warrant that the Service will meet your requirements or that its operation will be uninterrupted or error-free.

NetSketch provides tools for modeling financial growth, but any projections made using the Service are estimates and not guaranteed results. Actual financial outcomes may vary, and NetSketch is not liable for any discrepancies between projections and real-world outcomes.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any bugs, viruses, or the like that may be transmitted to or through the Service by any third party.

13. Indemnification

You agree to indemnify and hold harmless NetSketch and its creator from any claims, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of your use of the Service or your violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted in Amsterdam, The Netherlands.

15. Miscellaneous

• Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent.
• Entire Agreement: These Terms constitute the entire agreement between you and us regarding the use of the Service.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
